How Are Paternal Rights Terminated?

In the state of Florida, a father who has legally acknowledged paternity out of wedlock has sixty days to rescind his admission. After that, terminating paternal rights becomes a lot more difficult.

The legal father must submit:

  • An affidavit to the Florida courts stating that there has been new evidence that has come to light since the initial paternity acknowledgment.
  • Scientific evidence (genetic test) that proves that he’s not the child’s biological father. This can be his own genetic test disproving his paternity or the genetic test of another man demonstrating that that individual is, in fact, the child’s biological father.

Barring this scientific proof, the petitioning father must ask the courts to order a genetic test. Our firm can arrange scientific genetic testing to prove or disprove claims of paternity.
