Recently, a case involving a modified alimony has been remanded. The former
husband challenged a final order, which modified
an alimony to an increased amount. He states that the trial court did not supply
sufficient reasons for the modified alimony amount that is to be awarded
to his ex-wife.
Currently, there is no explanation for the increased amount, and it is
not apparent as to how the trial court reached that decision. As a result,
the case must be reversed back to the trial court so that an explanation
may be provided.
In this particular case, the amount of the alimony can only be increased
if the former wife was legally responsible for supporting hers and her
ex-husband’s children. However, because the children are considered
of adult age, the law does not require the former wife to provide financial
assistance to the adult children, regardless of whether the former wife
has provided financial assistance to her children while they attend college.
The case will continue until a final decision is reached.
