New Administrative Order for Duval County, Florida

Administrative Order 2012-1 Department of Revenue (DOR) Cases – Modifications

On February 8, 2012, a new administrative order was filed which states that:

Exclusive Use and Possession of the Former Marital Home Ends on Remarriage

Pursuant to Fisher v. Fisher, 4D10-383 (Fla. 4th DCA January 25, 2012), exclusive use and possession of the former marital residence while the child is a minor must end upon the remarriage of the spouse who has exclusive use and possession of the home.

Imputing Income in a Divorce Case

In Middleton v. Middleton, 5D10-236 (Fla. 5th DCA January 6, 2012), the 5th DCA was reversed on the issue of imputing income to the wife. The wife was 50 years old, had a current nursing license and a master's degree in research and writing curriculum. The wife had stayed home with the parties children who were now grown.
