Managing Your Divorce Case from Start to Finish

Struggling to resolve your divorce is only going to make the relationship between yourself and your soon-to-be ex-spouse all the more argumentative than it might be already.

What Steps Are Involved in a Divorce?

To begin the divorce process in Florida you must first file a petition for dissolution of marriage which will be served to your spouse. Once your spouse receives this document they have 20 days to respond, submitting their requests for child custody, alimony, division of assets, and other desires for the divorce.

Next, there is the period of discovery, where you and your spouse are responsible to disclose all assets and financial paperwork. This period lasts between 45 and 60 days.

At this point, the divorce will proceed to mediation, which allows you and your spouse to resolve your case outside of court with your respective legal counsel and a third-party mediator. If you and your spouse can amicably agree on all aspects of your divorce in mediation, you will only need to attend one hearing to finalize the divorce agreement.

However, if your divorce becomes contested, then your case will proceed to trial where a family court judge will need to determine how assets, custody, alimony, and other elements will be awarded. When children are involved, the State of Florida will conduct a custody evaluation, also referred to as a "social investigation" that can take 3-4 months.

There is no legal mandate to work with a divorce attorney, however, having experienced legal counsel on your side can have a huge impact on the outcome of your case, especially if things become contested.
