What Is a Separation Agreement?

A separation agreement is a written contract between spouses who intend to live apart but are not yet divorcing. Florida does not recognize "legal separation" as a formal court status the way some other states do, which means a separation agreement functions as a private, binding contract rather than a court order — unless the parties choose to have it incorporated into a court proceeding.
