Federal Drug Crimes in Jacksonville

Federal Investigations Can Begin Before an Arrest or Indictment

You may learn about a federal drug investigation through contact from federal agents, a subpoena, execution of a search warrant, or a target letter from federal prosecutors. At that stage, you may not yet know what evidence the government has collected or how prosecutors view your role.

Federal cases follow different investigative procedures, court rules, and sentencing laws from Florida state drug prosecutions.

At Owenby Law, P.A., we represent clients facing serious drug crime allegations and federal criminal matters in Northeast Florida. Before answering substantive questions from investigators or prosecutors, speak with an attorney about the investigation, your rights, and the potential consequences of responding.

Call (904) 770-3141 or contact us online to discuss a federal drug investigation or charge with our criminal defense team.

More Than 125 Years of Combined Legal Experience

Our firm has served Northeast Florida for more than two decades, and our attorneys bring more than 125 years of combined legal experience to the matters we handle.

We use a team-based approach, drawing on multiple attorneys' backgrounds when evaluating evidence, legal issues, and potential strategies.

Senior Attorney Dustin Nemati began his legal career as a prosecutor in the Fourth Circuit State Attorney's Office in Jacksonville, where he handled misdemeanor and felony hearings and trials. He is also admitted to practice in the U.S. District Court for the Middle District of Florida.

That combination of trial experience and federal-court admission informs our review of serious criminal allegations while keeping the defense tailored to the client's actual circumstances and procedural stage.

Federal Drug Cases in the Jacksonville Division

Federal criminal cases connected to Jacksonville generally proceed in the Jacksonville Division of the U.S. District Court for the Middle District of Florida when the alleged conduct and federal venue rules place the case there.

The Jacksonville Division includes Baker, Bradford, Clay, Columbia, Duval, Flagler, Hamilton, Nassau, Putnam, St. Johns, Suwannee, and Union Counties.

Under the Middle District's local rules, the United States generally begins a criminal action in a division where at least one defendant allegedly committed a charged offense, subject to applicable law and transfer rules.

Federal prosecution is not limited to cases involving a particular drug quantity or conduct crossing state lines. Investigations involving federal agencies, interstate or international activity, alleged organizations, mail or parcel investigations, or other federal enforcement activity may lead to federal charges when the evidence and applicable statutes support them.

Drug quantity can significantly affect statutory penalties, but quantity alone does not determine whether a case is federal.
