What Is a DUI in Florida?

Under Florida law, a person may be charged with driving under the influence if they are operating or in actual physical control of a vehicle while impaired by alcohol, drugs, or a combination of substances.

A DUI charge may arise when:

  • A driver's blood alcohol concentration (BAC) is 0.08% or higher
  • Alcohol or drugs substantially impair normal faculties
  • Prescription medications affect the ability to drive safely
  • Illegal substances impair driving ability

Importantly, prosecutors do not always need a BAC result above the legal limit to pursue a DUI conviction. Observations made by law enforcement officers, field sobriety exercises, and other evidence may be used to support allegations of impairment.

What Happens After I'm Arrested?

Following a DUI arrest in Jacksonville, the legal process begins immediately. Understanding what to expect can help reduce uncertainty and allow you to make informed decisions.

Traffic Stop and Investigation

Most DUI cases begin with a traffic stop. An officer may claim they observed:

  • Speeding
  • Weaving between lanes
  • Running a traffic signal
  • Erratic driving behavior

The officer may then conduct an investigation that includes questioning, field sobriety exercises, and requests for breath, blood, or urine testing.

Arrest and Booking

If the officer believes there is probable cause to suspect impairment, you may be arrested and transported to the Duval County Jail for booking.

Administrative License Suspension

Your physical driver's license is confiscated upon arrest. If you blew a 0.08 or higher, or if you refused the breath test, your citation serves as a temporary 10-day driving permit (for business purposes only). You must file a formal request for an administrative hearing or waive the hearing for an immediate hardship license within 10 days, or face a complete suspension of your driving privileges lasting 6 to 12 months.
