Gun Charges Attorney in Jacksonville

Former-Prosecutor Insight for Florida Firearm Charges

Florida firearm cases can involve unlawful possession, carry-related allegations, improper exhibition, discharge of a weapon, or allegations that a firearm was used during another offense. The charge and potential consequences depend on the statute, the accused person's legal status, where the firearm was found, how it was carried or used, and what prosecutors can prove.

At Owenby Law, P.A., our Jacksonville criminal defense team reviews the stop, search, seizure, questioning, and arrest along with the evidence the State uses to connect a person to a firearm.

When a firearm allegation accompanies another felony, we also examine whether Florida's sentencing-enhancement provisions actually apply to the underlying charge and alleged conduct.

Team-Based Defense With Former-Prosecutor Perspective

Our attorneys use a collaborative approach to criminal defense while tailoring the strategy to the specific allegations and evidence.

Senior Attorney Dustin Nemati began his legal career as a prosecutor in Jacksonville's Fourth Circuit State Attorney's Office, where he handled hearings and trials in both misdemeanor and felony cases.

That background provides perspective on how prosecutors evaluate evidence, make charging decisions, and prepare criminal cases for trial. Our team draws on that experience while independently examining the State's theory and the circumstances of the individual case.

Florida Gun & Firearm Charges We Handle

Florida Chapter 790 contains numerous laws involving firearms and other weapons. Other criminal statutes can also apply when a firearm is allegedly connected to another offense.

Potential allegations may involve:

  • Unlawful concealed carry: Florida permits qualifying people to carry concealed firearms without a license, but restrictions involving eligibility, location, and other circumstances still apply.
  • Firearm possession by a prohibited person: Florida law restricts possession of firearms and ammunition for certain people with felony convictions or qualifying delinquency adjudications.
  • Firearm possession while subject to an injunction: A qualifying final domestic violence, stalking, or cyberstalking injunction can prohibit possession or control of firearms and ammunition.
  • Improper exhibition of a firearm: Displaying a firearm in a rude, careless, angry, or threatening manner may result in criminal allegations when the conduct is not legally justified.
  • Certain restricted firearms: Florida regulates possession of short-barreled rifles, short-barreled shotguns, and machine guns, subject to statutory exceptions including certain firearms lawfully owned and possessed under federal law.
  • Unlawful discharge: Florida law regulates firearm discharges in specified public, roadway, occupied-premises, and residential-property circumstances.
  • Firearm allegations connected to another felony: Possession, display, discharge, or use of a firearm during certain felony offenses can affect the classification of the charge or sentencing exposure.

A firearm's presence does not automatically establish which statute or enhancement applies. The charging document and evidence must be evaluated together.
