Lump Sum & Periodic Alimony Awards in the State of Florida

In most cases, the circuit court judges who oversee divorce proceedings in the court venues of counties like Duval prefer to award periodic payments. There are cases, however, when it can be shown that there is good reason to order a larger lump sum payment.

Some examples of this would be:

Due to extreme discord, there is a need to completely sever any further contact between the two parties
It can be shown that the party who is required to pay spousal support has a history of dissipation of assets
The payor has proven himself or herself to be unreliable
The age or health of the spouse who is required to pay, places the prospect of continual payments in doubt

Lump Sum Alimony Restrictions

In situations like these, the court could order a single payment, in lieu of continuous monthly spousal support payments. There are, however, restrictions on lump sum alimony payments. For instance, lump sum alimony cannot be used to satisfy outstanding debts between the spouses.
