Obtaining Lump Sum Alimony Payments

Family Law Lawyers in Jacksonville, FL

We, the Jacksonville divorce attorneys at Owenby Law, P.A., represent individuals who are seeking to collect alimony pursuant to the dissolution of their marriages.

Additionally, we protect clients who are attempting to defend themselves against erroneous claims for spousal maintenance. In the state of Florida, all forms of alimony—durational, bridge-the-gap, or rehabilitative—may be awarded in the form of periodic payments or as one lump sum.

The manner in which the alimony is paid is determined by the judge presiding over the divorce. If you are seeking alimony, you know that you are likely to have to pay spousal support, or you are seeking a modification of maintenance, our experienced divorce team can discuss your case with you.

Our Jacksonville lump sum alimony lawyers are here to help! Free consultations are offered to prospective clients. Call (904) 770-3141 or send us a message online to request yours.

Lump Sum & Periodic Alimony Awards in the State of Florida

In most cases, the circuit court judges who oversee divorce proceedings in the court venues of counties like Duval prefer to award periodic payments. There are cases, however, when it can be shown that there is good reason to order a larger lump sum payment.

Some examples of this would be:

  • Due to extreme discord, there is a need to completely sever any further contact between the two parties
  • It can be shown that the party who is required to pay spousal support has a history of dissipation of assets
  • The payor has proven himself or herself to be unreliable
  • The age or health of the spouse who is required to pay, places the prospect of continual payments in doubt

Lump Sum Alimony Restrictions

In situations like these, the court could order a single payment, in lieu of continuous monthly spousal support payments. There are, however, restrictions on lump sum alimony payments. For instance, lump sum alimony cannot be used to satisfy outstanding debts between the spouses.
