Is a DUI a Felony or a Misdemeanor?

First-time DUI offenses are usually charged as misdemeanors. However, in cases of subsequent offenses and aggravated DUI cases, a person who is arrested for drunk driving could be charged with a felony. Florida law specifies that a driver who commits their third DUI offense in 10 years or their fourth overall DUI offense will be charged with a felony.

The term “aggravated DUI” is used to describe any DUI case which involves factors that make the crime seem more serious than other cases. For example, a person may be charged with aggravated DUI if they had a blood alcohol concentration (BAC) that was especially high, if a child was in the car, or if the DUI occurred in conjunction with other offenses, such as driving without a license. DUI cases that involve an accident are often considered as “aggravated” as well, especially when severe injuries or deaths result.

What are the Penalties of a DUI in Florida?

Every state has its own terms for DUI penalties, which define details like the length of potential jail time and the amount of fines. These terms are often dependent on how many prior DUI convictions a person has, and other factors in their case such as level of intoxication or resulting damage. The consequences for DUI in Florida range from up to six months in jail time and up to $1,000 in fines for a first offense, to up to five years in jail and up to $5,000 in fines for a felony offense.
