A Criminal Appeal Starts With the Record, Not a New Trial
A criminal conviction or sentence can sometimes be challenged through Florida’s appellate process, but an appeal is fundamentally different from the trial that came before it.
A direct appeal does not ordinarily give the defendant another opportunity to present the case to a new jury. Instead, an appellate court reviews the existing record to determine whether a preserved legal error occurred and whether that error warrants appellate relief.

How Long Do You Have to File a Florida Criminal Appeal?
The ordinary deadline is short.
Under Florida Rule of Appellate Procedure 9.140, a defendant pursuing a typical direct appeal may file the notice of appeal after rendition of the final judgment and must generally do so no later than 30 days after rendition of the written order imposing sentence.
That notice begins the appellate process.
Missing the ordinary deadline can jeopardize appellate rights. Florida law does provide limited procedures for seeking a belated appeal in certain circumstances, but those procedures have their own requirements and should not be treated as a substitute for filing a timely notice.
If you have recently been convicted or sentenced, the safest approach is to have the relevant dates reviewed promptly.
Jacksonville Criminal Appeals Go Through Florida’s First District Court of Appeal
Duval County is part of Florida’s Fourth Judicial Circuit, together with Clay and Nassau Counties.
That circuit falls within the jurisdiction of Florida’s First District Court of Appeal.
For a qualifying state criminal appeal arising from Jacksonville, the appellate process therefore involves a different court, different procedural rules, and a different type of legal advocacy from the trial proceedings that produced the judgment or sentence.
Appellate practice is driven heavily by written records, preservation of error, briefing, legal research, and standards of review.
What Can Be Challenged on Direct Appeal?
A disappointing outcome by itself is not enough to reverse a conviction or sentence.
A direct appeal focuses on legal issues that are properly reviewable from the existing lower-court record.
Depending on what occurred in the case, potential appellate issues may involve:
- Evidentiary rulings
- Jury instructions
- Preserved constitutional issues
- Certain prosecutorial errors
- Rulings on motions made before or during trial
- Sentencing errors
- Other preserved legal or procedural errors
Whether a particular issue can be reviewed depends on what happened in the trial court, how the issue was raised, whether it was preserved, the applicable standard of review, and whether the error could have affected the result.
